Can PEI legally ban GE?

Mid-way through the public hearings, the Committee, concerned by the testimony of two industry “experts,” solicited a legal opinion on the feasibility of declaring the province GE-Free.

On March 16, 2005, the Committee received a legal opinion from provincial government lawyers that PEI has the legal latitude to ban genetically engineered organisms.

The only exception is if there are federal rules that override the provincial laws. Provincial lawyers have found there are no federal rules in place to prevent a ban on GE crops.
